A claim exists when someone causes damages to another person because of their negligence. In general, negligence is the failure to use reasonable care. Reasonable care is what a reasonable person would use in similar circumstances. A good example of this standard is when a person runs a red light and causes a collision with another car. The person running the red light failed to exercise reasonable care, and was therefore negligent in their driving.

In general, a plaintiff must prove that another person/entity was at fault before a plaintiff may recover damages.
